Car Accident On Interstate 90 East of Billings

The Montana Highway Patrol believes that alcohol was a factor in a rollover accident on Interstate 90, east of Billings. The MHP indicated that a GMC Yukon was in initially in a minor accident near exit 497 on October 15. However, the driver and passenger then reportedly got back on the road and continued on their way, according to the Billings Gazette. Two miles to the east on I-90, at about 7 p.m., the motorist allegedly over-corrected after leaving the road, causing the SUV to roll over.

One Person Ejected, Another Trapped

The 43-year old male passenger was ejected, and the 75-year old male driver was trapped inside the vehicle. The motorist was extricated from the Yukon, and both men were initially transported to Big Horn Memorial Hospital. The passenger was later transferred to St. Vincent Healthcare in Billings where he succumbed to his injuries the next day, according to the Big Horn County Coroner. There was no immediate update on the condition of the motorist involved in the wreck. There was also no initial report as to whether the blood alcohol level of the driver had been determined.

Investigation Ongoing

Although the exact details surrounding this vehicular accident are not fully known in the immediate aftermath of the incident, the MHP has indicated that alcohol may have factored into the fatal event. When a passenger dies as the result of a driver's negligent conduct, the laws of the state of Montana do allow survivors to seek compensation from that motorist and his insurer. If blood alcohol levels exceed legal limits, this fact can be asserted as evidence of the negligent operation of a motor vehicle.

In certain cases, it may be recommended that a wrongful death lawsuit be filed in the appropriate civil court. Such litigation may seek compensation for burial expenses, pain and suffering and loss of companionship.
