    • False Claims Act / Whistleblower Settlement - 2018 $24,000,000.00

      he largest False Claims Act recovery in Montana history. Representing a whistleblower CFO for a large Montana medical facility, Paul Odegaard acted co-counsel with lead counsel, Bryan Vroon, an Atlanta-based attorney, to bring sweeping complaints of wrongdoing to investigators with the Offices of Inspector General in the U.S. Department of Health and Human Services and Department of Justice, which launched a two-year investigation. The six-count lawsuit, filed in United States District Court, District of Montana, centered on alleged violations of the Anti-Kickback Statute, a criminal law prohibiting financial arrangements between doctors and hospitals or other health-care providers or companies, and the civil Stark statute, a federal physician self-referral law designed to prevent financial incentives for physicians to steer patients to particular providers from whom they stand to reap benefits. The settlement agreement included a payment to the Federal government and State of Montana in the combined amount of $24 million.

    • Insurance Bad Faith Settlement - 2018 $1,800,000.00

      Paul Odegaard represented an oil field trucker who injured his low back while changing a tire during a work shift. While the work comp claim was initially accepted, the insurer later denied the claim after obtaining a medical causation opinion from a bought and paid for orthopedic surgeon, also called an Independent Medical Examiner by insurance companies. The insurance company doctor was not provided with all of the critical medical records and spent less than 10 minutes with the client. After the denial was taken all the way to the Montana Workers’ Compensation Court, where the denial was reversed and the insurer was penalized, Mr. Odegaard filed a lawsuit alleging common law and statutory insurance bad faith claims. Critical to the bad faith settlement amount was the unrefuted medical opinion secured by Mr. Odegaard that the clients low back condition had been permanently compromised due to the delays in critical medical treatment due to the work comp insurer’s denial of any medical treatment for nearly 18 months.

      Our Client, a water truck driver working in the oil fields of Montana and North Dakota, was severely injured when he was run off the road by another semi-truck. Initially, his Workers’ Compensation claim was filed in North Dakota, where benefits are less favorable compared to Montana.     • Workers’ Compensation Motor Vehicle Accident - 2017 $360,000.00

      Our client injured his low back in a motor vehicle accident while driving a semi for his employer. Despite the fact that he did not seek medical treatment for his back for almost a month, and he had only incurred approximately $15,000 in medical bills, our firm was able to secure over $360,000 in compensation for him. This client contacted our firm when the workers’ compensation insurer attempted to recoup the monies it paid from the auto insurer from the at-fault driver. We were able to prevent the workers’ compensation insurer from recouping the monies it spent, which resulted in a significant recovery for our client.

    • Workers’ Compensation Medical Only Settlement – Medicare Set Aside - 2016 $350,000.00

      Our Client, who had been permanently and totally disabled for worker’s compensation purposes since 1991, asked for our help in negotiating a settlement for her claim related medical benefits. This presented many complicated issues given our Client’s status as a Medicare beneficiary. We were able to obtain a favorable Medicare Set Aside projection, approval by Medicare of that figure, and a significant sum of money above and beyond the Medicare set-aside amount, totaling $350,000.00, which allowed our Client to use the “to boot” settlement proceeds for medical treatments that were not otherwise covered by traditional workers’ compensation and Medicare coverage. Plus, our Client was pleased to “get out” of the Worker’s Compensation system and its frustrating requirements of preauthorization, medical care within the Utilization and Treatment Guidelines, etc.

    • Motor Vehicle Accident - 2017 $345,000.00

      Our clients were injured in an auto accident near Billings, Montana. The insurers for the at-fault driver denied liability and offered our clients nothing. At this point, our firm was retained. The insurers continued to deny liability and maintained their zero-dollar offer.       Client injured his low back while working as a manager for a hardware store. Conservative medical treatment followed and the client returned to the time of injury employer. However, the workers’ compensation insurer contended that no additional medical treatment would be needed and declined to approve requests for additional conservative treatment.     • Health Insurance Denial Settlement - 2018 $175,000.00

      Paul Odegaard represented a local physician whose recommended cervical artificial disc replacement surgery was denied by his health insurer. The insurer claimed the proposed surgery, although FDA approved, was considered “experimental and investigational.” Mr. Odegaard filed suit, alleging breach of contract and insurance bad faith claims. The settlement amount represented about 5 times what the health insurance company would have paid for the surgery under its contracted rate schedule, if the insurer had simply preauthorized the procedure.

    • Personal Injury Settlement - 2015 $175,000.00

      $175,000 settlement for a client who was the victim of a dog bite. We fought for insurance coverage under the dog owner’s automobile and homeowners’ insurance policies. The insurer’s disputed liability and we obtained payment for medical benefits through our client’s health insurer. Ultimately, the auto and homeowner’s insurer agreed to settle the claim when faced with the prospect of a lawsuit.

    • Motor Vehicle Accident - 2018 $167,454.95

      Client with an extensive history of back, shoulder, and neck treatment involved in a fairly low-speed motor vehicle accident. The at-fault insurer paid for the client’s treatment over the first two months; however, when the client needed surgery on his shoulder, the insurer refused further payment, claiming the surgery was due to a pre-existing condition and not the motor vehicle accident. After we obtained a favorable causation opinion from the client’s surgeon, we were able to not only obtain the remaining policy limits under at-fault driver’s insurance policy, but nearly three-quarters of the client’s underinsured motorist coverage under his own policy. Between the two insurers, we were able to recover $167,454.95 after the at-fault insurer’s denial, which was more than four times our client’s medical expenses.

    • Motor Vehicle Accident - 2018 $150,000.00

      T otal recovery for client involved in two separate motor vehicle accidents that were three months apart. We obtained the full liability limits from the at-fault drivers in both accidents, as well as a sizeable sum from our client’s own no-fault insurance coverage from her own automobile insurer. The full settlement was more than five times our client’s total medical bills.

      Client injured his neck at work. The workers’ compensation insurer denied liability, claiming that the client did not timely report the injury and the reported mechanism of injury could not have caused the injury to his neck. We sent the client to an orthopedic surgeon for a consultation and causation opinion. Ultimately, we forced the insurer to pay for the neck surgery and pay wage loss benefits for over a year while the client recovered from surgery. We referred our client to a different neurologist who thoroughly reviewed the client’s medical history and confirmed his dizziness was related to his workplace injury, contrary to the opinion rendered by the insurer’s doctor. We ultimately settled the claim for over five times the insurer’s opening settlement offer.
